Government statistics show nearly 600 people have been arrested for same-sex activity since it was recriminalised in India. Home Ministry numbers show 778 registered cases and 587 arrests under Section 377 of the Indian Penal Code since it was reinstated in December 2013. The Section of the law punishes same-sex relations with up to life imprisonment. Delhi is leading the way with 140 cases and 110 arrests, with figures only up till September. When it recriminalised gay sex, India’s Supreme Court said only about 200 people had been prosecuted under Section 377 since 1857, so the law was not being misused. Efforts continue to have the law struck down once more.
